DESCRIPTION
2020 was a turning point during which we saw innovation and technology compliment unprecedented challenges to the practice of law. As the devastating effects of COVID-19 permanently altered the world’s systems, work-from-home culture became the norm, forcing attorneys to examine both data privacy and security measures and guidelines around the practice of law.
As we navigate this new era, what type of technology should attorneys consider using in their practice? What are some of the ethical and cybersecurity considerations that attorneys need to be aware of? This webinar will frame such considerations and explore competence, data security and privacy, jurisdiction and supervision issues relevant to both in-house and outside counsel.

David J. Kaplan | General Counsel | AXEL
David J. Kaplan is Vice President and General Counsel of Nevada-based, deep-tech pioneer, AXEL, where he represents the company in litigation and transactions, and handles its everyday legal affairs. Highlights of Mr. Kaplan’s work since joining AXEL include success as lead counsel in front of various courts such as the Supreme Court of Nevada and U.S. District Courts, planning and executing the legal strategy and compliance surrounding the development, launch, and distribution of AXEL Tokens, and spearheading the growth of the company’s patent portfolio such that it has tripled in three years, with the company now having 15 issued patents and numerous more applications pending. Before joining AXEL, Mr. Kaplan gained in-house experience while serving as General Counsel to an e-commerce company. Mr. Kaplan spent the first nine years of his career as an attorney at a top U.S. intellectual property law firm in New York City, where he focused on patent law and complex corporate litigation. Mr. Kaplan received a B.S.E. in aerospace engineering from the University of Michigan College of Engineering and a law degree from Rutgers University. While earning his undergraduate degree, Mr. Kaplan gained technical experience in mechanical and electrical engineering. Mr. Kaplan has been active in the Intellectual Property Law Section of the State Bar of Nevada for several years, served as the section’s Treasurer in 2020, and is currently serving as its Secretary.
Nancy B. Rapoport | Garman Turner Gordon Professor of Law | William S. Boyd School of Law, University of Nevada, Las Vegas
Nancy B. Rapoport is the Garman Turner Gordon Professor of Law at the William S. Boyd School of Law, University of Nevada, Las Vegas, and an Affiliate Professor of Business Law and Ethics in the Lee Business School at UNLV. After receiving her B.A., summa cum laude, from Rice University in 1982 and her J.D. from Stanford Law School in 1985, she clerked for the Honorable Joseph T. Sneed III on the United States Court of Appeals for the Ninth Circuit and then practiced law (primarily bankruptcy law) with Morrison & Foerster in San Francisco from 1986-1991. She started her academic career at the Ohio State University College of Law in 1991, and she moved from Assistant Professor to Associate Professor with tenure in 1995 to Associate Dean for Student Affairs (1996) and Professor (1998) (just as she left Ohio State to become Dean and Professor of Law at the University of Nebraska College of Law). She served as Dean of the University of Nebraska College of Law from 1998-2000. She then served as Dean and Professor of Law at the University of Houston Law Center from July 2000-May 2006 and as Professor of Law from June 2006-June 2007, when she left to join the faculty at Boyd. Ms. Rapoport served as Interim Dean of Boyd from 2012-2013, as Senior Advisor to the President of UNLV from 2014-2015, as Acting Executive Vice President & Provost from 2015-2016, as Acting Senior Vice President for Finance and Business (for July and August 2017), and as Special Counsel to the President from May 2016-June 2018.
Jessica A. Schoendienst | Senior Legal Counsel | Sierra Nevada Corporation
Jessica A. Schoendienst is Senior Legal Counsel at Sierra Nevada Corporation, a privately held aerospace and national security contractor, headquartered in Sparks, Nevada, specializing in advanced engineering technologies in Space Systems, Commercial Solutions, and Defense and National Security. With applications including navigation and guidance, communication and surveillance systems, electronic warfare, aircraft systems, and telemedicine, SNC provides state-of-the-art solutions to military and commercial customers. In her role, she advises the company on a wide range of legal issues. Her responsibilities include managing employee relations and benefits, ethics, intellectual property and trade secret management, and litigation matters. A primary part of her focus is offering solutions and coaching that is proactive, compliant, and practical. Before joining Sierra Nevada Corporation, Ms. Schoendienst was an attorney at a California law firm representing management in labor and employment matters. Ms. Schoendienst received her BS in Business Administration from California State University, Chico in 2007 and graduated with distinction from the University of the Pacific, McGeorge School of Law in 2015. Ms. Schoendienst serves on the Board of Directors for the Nevada Chapter of the Association of Corporate Counsel.
George L. Washington, Jr. | Chief Litigation Counsel | Orange Business Services
George L. Washington is Chief Litigation Counsel at Orange Business Services in Oak Hill, Virginia. He is primarily responsible for litigation and employment law matters for the company’s North and South American entities and he serves as the company’s Ethics Advisor. In addition, he advises senior management globally on a broad range of issues, including investigations, compliance obligations and personnel matters involving high-ranking managers in various countries. Previously, Mr. Washington worked in private practice at Covington & Burling LLP in Washington, D.C. He is a 1988 graduate of Princeton University and received his M.P.P. and J.D. in 1991 and 1994, respectively, from the University of California at Berkeley. He is a member of the ABA Section of Labor and Employment Law and is currently serving a second term on the section’s governing Council. In 2019, he was elected into the College of Labor and Employment Law.
